Notice from the Ministry of Industry and Information Technology on Organizing Commercial Trials of Satellite IoT Business

Communications management bureaus of all provinces, autonomous regions, and municipalities directly under the central government, and relevant enterprises:
The development of satellite Internet of Things is an important measure to implement the decisions and deployments of the Party Central Committee and the State Council, and to support the development of commercial aerospace. It is of great significance for further comprehensively deepening reforms, cultivating and building new quality productive forces. In accordance with the relevant requirements of the "Guiding Opinions of the Ministry of Industry and Information Technology on Optimizing Business Access and Promoting the Development of Satellite Communication Industry", in order to support the standardized and healthy development of satellite IoT business, we are now organizing commercial trials of satellite IoT business. The relevant matters are notified as follows.
1、 Commercial test objectives
Satellite IoT business refers to a low-speed data service that connects various IoT devices through satellite communication technology, providing wide area IoT connectivity for various terminals such as data collection terminals, wearable devices, handheld terminals, as well as transportation vehicles such as cars, ships, and airplanes.
By conducting commercial trials of satellite IoT business, enriching the supply of satellite communication market, stimulating the vitality of market entities, enhancing industry service capabilities, establishing a safety supervision system, forming replicable and promotable experiences and models, supporting the safe and healthy development of emerging industries such as commercial aerospace and low altitude economy, and serving the construction of a new development pattern.
2、 Approval of experimental application
（1） Application requirements
The commercial trial objects of satellite IoT business are eligible enterprises. Enterprises provide satellite IoT services by building satellite IoT constellations, establishing customer service systems, as well as billing, accounting and other business support systems.
Enterprises applying for commercial trials of satellite IoT services shall comply with the Telecommunications Regulations of the People's Republic of China and the Radio Management Regulations of the People's Republic of China
According to the relevant provisions of the Measures for the Administration of Telecommunications Business License, the following conditions should be met:
1. The enterprise is a legally established company;
2. Have funds and professional personnel suitable for conducting business activities;
3. Necessary venues and facilities, and their satellite IoT constellations should comply with the relevant provisions of the "Regulations on the Administration of Approval and Filing of Enterprise Investment Projects";
4. The reputation or ability to provide long-term services to users;
5. There is a scientifically sound commercial experimental plan that can meet the requirements of network operation security, service quality, code resource management, network and data security management, important communication, real name management, prevention and governance of telecommunications network fraud, radio security management, as well as other security technical guarantee measures;
6. Other conditions stipulated by the state.
（2） Approval process
Enterprises applying for commercial trials of satellite IoT services shall submit application materials and relevant certification materials to the local communication management bureau. After the preliminary review is completed by the local communication management bureau, recommendations will be made to the Ministry of Industry and Information Technology (Information and Communication Management Bureau). The Ministry of Industry and Information Technology reviews the application materials in accordance with relevant laws and regulations, organizes expert evaluation and argumentation, and approves the commercial testing of eligible enterprises.
3、 Business operation requirements
Enterprises should fulfill their main responsibilities, implement the following requirements, conduct commercial experiments in accordance with laws and regulations, and provide satellite IoT services nationwide or across provinces, autonomous regions, and municipalities directly under the central government.
1. Carry out the system construction and business opening work of satellite IoT business, comply with the requirements of network operation security, service quality, code resource management, etc., and ensure the smooth communication of the network;
2. Reserve satellite communication resources in accordance with the requirements of the Ministry of Industry and Information Technology and ensure emergency communication support;
3. Fully guarantee users' right to know and choose, and provide satellite IoT services after signing contracts with users;
4. Comply with the management regulations for direct connection of terminal equipment to satellite services, and access and use telecommunications equipment that has obtained network access permits in accordance with laws and regulations;
5. For IoT network cards using embedded user identification cards (eSIM), a special review must be organized and approved by the Ministry of Industry and Information Technology before implementation;
6. Submit relevant business data according to the requirements of the Ministry of Industry and Information Technology, access the industrial Internet identity resolution system, support Internet Protocol Version 6 (IPv6), and support the full life cycle management of the satellite Internet of Things;
7. Based on the characteristics of satellite IoT business, implement requirements related to network security and data security management, important communication, real name system management, and prevention and governance of telecommunications network fraud, and strengthen business and security management;
8. Comply with radio safety management requirements, regulate the use of radio frequencies, effectively utilize radio spectrum resources, and avoid harmful interference with other radio frequencies used in accordance with the law;
9. Comprehensively sort out the application scenarios of satellite IoT business, classify and refine specific management measures, and timely, completely, and accurately report business application scenarios, business development status, and other information to the Ministry of Industry and Information Technology.
4、 Experimental exit mechanism
Enterprises that have obtained commercial test approval may have their commercial test approval and qualifications revoked by the Ministry of Industry and Information Technology in accordance with the law and regulations if they are unable to provide services on time or have serious violations of laws and regulations. Enterprises that withdraw from commercial trials should safeguard the legitimate rights and interests of users in accordance with relevant laws and regulations, and properly handle the aftermath work such as the transfer and withdrawal of existing users.
5、 Organizational management guarantee
The Ministry of Industry and Information Technology, as the telecommunications regulatory authority, is responsible for organizing, implementing, summarizing, and evaluating commercial trials of satellite IoT services. As the local telecommunications management agency, the local communication management bureau shall establish and improve the management guarantee mechanism, and do a good job in the application recommendation, service management, work guidance, supervision and inspection of commercial trials of satellite IoT services for local enterprises. In the application recommendation and "double random one public" inspection, it shall conduct on-site inspections of its business situation, financial situation, site facilities, personnel situation, etc., and timely report relevant information and problems.
6、 Summary of commercial experiments
The commercial trial period is two years. Enterprises that have obtained approval for commercial testing shall regularly review and summarize the situation and problems of commercial testing every year, and report to the Ministry of Industry and Information Technology. The Ministry of Industry and Information Technology evaluates the commercial testing situation, timely summarizes advanced experiences, models, typical cases, etc. of commercial testing, and promotes them.
Starting from the date of issuance of this notice, commercial testing work will be initiated. Based on the progress of commercial trials, the Ministry of Industry and Information Technology will timely improve relevant policies and study the formal implementation of satellite IoT services.
