The Daxing District People's Court of Beijing ordered Tesla to provide complete driving data for half an hour before the accident in the first instance.
In April 2021, Ms. Zhang attracted widespread attention for shouting "brake failure" on the roof of a Tesla car at the Shanghai Auto Show. Subsequently, the Shanghai police imposed a five-day administrative detention on Ms. Zhang for disturbing public order. She has been continuously requesting Tesla to provide complete driving data since her father's rear end collision in February 2021, but has been repeatedly refused. The traffic police determined that Ms. Zhang's father was fully responsible for the accident, but her family believed that the cause of the accident was brake failure.
In October 2021, Tesla (Shanghai) Co., Ltd. sued Ms. Zhang, accusing her of infringing on the company's reputation rights through her "roof protection" behavior at the Shanghai Auto Show, and demanded a compensation of 5 million yuan. After 4 years of trial, on July 11, 2025, Shanghai No.2 Intermediate People's Court made a second instance judgment, upholding the original verdict and determining that Ms. Zhang had infringed upon Tesla's reputation rights. She was required to apologize to Tesla and compensate 170000 yuan.
On September 16, 2025, the People's Court of Daxing District, Beijing, made a judgment on the case of Ms. Zhang v. Tesla Sales Service (Beijing) Co., Ltd. and other sales contract disputes, determining that Tesla, as the operator, should protect consumers' right to know and ordering it to provide Ms. Zhang with complete driving data for the thirty minutes before the accident.
On September 16th, Ms. Zhang, the party involved, told "Zheng News" that she initially sued Tesla for a product quality case, but the data was incomplete at the time and Tesla had not provided complete data, so she changed the cause of the case to a data case.
She will apply for judicial appraisal after obtaining complete data to verify the authenticity and completeness of the data, and use the data as a basis for judicial appraisal of the brakes.
